Dear Foreign Secretary,
I’m writing to raise concerns over Israel’s system of arrest and detention in the occupied Palestinian territory (oPt), including its illegal use of administrative detention.
Israel holds hundreds of Palestinians from the oPt in administrative detention, imprisoned without charge or trial, usually on 'secret evidence' not available to the detainee or their lawyer. This is an ongoing issue which the UK government has noted too many times to count, for years on end: Israel’s systematic use of administrative detention is a violation of international law, as is the transfer of prisoners from occupied territory into Israel, which is the situation for nearly all Palestinian prisoners from the oPt held by Israel. As the UK government has noted, this is a violation of the Fourth Geneva Convention, and a war crime under international law.
Given the gravity and persistence of these issues for so many years, it is clear that merely raising the topic with your Israeli counterparts is having no effect. If the UK is serious about human rights and the rule of law, it must introduce consequences for Israel’s immoral and illegal treatment of Palestinian prisoners. More pointedly, the UK should press Israel to immediately release all Palestinian prisoners held in violation of international law, including the hundreds held in administrative detention, and the thousands held in prisons after illegal transfer.
In addition to this, the UK’s ongoing trade in arms with Israel despite these systemic violations of law only serves to reward illegality. In the past years, the UK has approved the export of weapons components and equipment of the type used by Israeli forces in arrest raids, and in the daily maintenance of the illegal occupation of Palestinian territory. The UK’s own policy on arms exports, if implemented, would prohibit the sale of arms to Israel because of its violations of international law. The UK should follow its own rules, and stop the sale of weapons to Israel so long as its violations, including breaches of the Geneva Convention, continue.
I’d appreciate a response detailing how the UK intends to uphold its commitments to international law with regard to Israel’s illegal arrest and detention of Palestinians, especially the use of administrative detention.
